Chapter 26 Annex 2 Part 3 - Wording for refusals: Sections 11-15

11. "Au Pair" placements

11.1 Purpose to learn English "...but I am not satisfied that you are going to the United Kingdom for the purpose of learning the English language, or that you will be taking up an arranged placement which can be shown to fall within the definition of an "Au pair" placement as set out in the Immigration Rules."

11.2 Not an English-speaking family "...but I am not satisfied that you will live for a time as a member of an English speaking family, of that you will be taking up an arranged placement which can be shown to fall within the definition of an "Au pair" placement as set out in the Immigration Rules."

12. Working holiday makers

12.1 Non-commonwealth citizen "...but you are a national of ... and consequently not a commonwealth citizen."

12.2 Over/under/wrong age "...but from the evidence I have received, I am not satisfied you are aged between 17 - 27 tears inclusive."

12.3 Married "...but I am not satisfied that you are unmarried or married to a person who [meets the requirements for leave to enter the United Kingdom as a working holiday maker and who intends to take a working Holiday with you] intends to take a working holiday with you."

12.6 Employment not incidental "...but I am not satisfied that you are intending to take only employment which is incidental to a holiday and not: engage in business/provide services as [a professional sportsman/an [entertainer]/pursue a career in the United Kingdom."

12.7 Dependent children "...but I am not satisfied that you do not have: a dependant child/ dependant children over 5 years of age/who will reach 5 years of age before you complete your working holiday."

12.8 Commitments "...but I am not satisfied that you do not have commitments which would require you to earn a regular income."

12.9 Intention to leave "...but I am not satisfied that you intend to leave the United Kingdom at the end of your working holiday."

13. Children of working holiday-makers

13.1 Not related as claimed "...but I am not satisfied that you are the child of a parent [to be] admitted to/allowed to remain in the United Kingdom as a working holiday-maker."

13.2 Parent refused entry clearance "...but your mother/father’s application for entry clearance in that capacity has been refused and consequently I am not satisfied that you are the child of a parent who is to be admitted to or allowed to remain in the United Kingdom as a working holiday-maker."

13.3 Parent not in UK or in appropriate category "...but I am not satisfied that you are the child of a parent admitted to or allowed to remain in the United Kingdom as a working holiday-maker."

13.4 Over 5 years of age "...but on the evidence I have received I am not satisfied that you are under the age of 5."

13.5 Nearly 5 years of age "...but as you were born on ... and your parent(s) intend to remain in the United Kingdom on a working holiday: for 2 years/until ... I am not satisfied that you will leave the United Kingdom before reaching the age of 5."

13.6 Maintenance and accommodation "...but I am not satisfied that you can and will be maintained and accommodated adequately: without recourse to public funds/your parent[s] engaging in business/taking employment not relevant to a working holiday."

13.7 Not accompanying both parents "...but I am not satisfied that both your parents are being/have been admitted to/allowed to remain in the United Kingdom, or that the parent you are to accompany is your sole surviving parent or has had sole responsibility for your upbringing, or that there are serious and compelling family or other considerations which make your exclusion from the United Kingdom undesirable."

14. Seasonal worker at agricultural camps

14.1 Not a student in full-time education "...but I am not satisfied that you are a student in full-time education or that your are returning for another season at the specific invitation of the farmer."

15.1 Not an approved scheme "...but I am not satisfied that you are going to an educational establishment in the United Kingdom under an exchange scheme approved by the Education Departments or administered by the Central Bureau for Educational Visits and Exchanges/the League for the Exchange of commonwealth Teachers."

15.2 Intention to leave "...but... I am not satisfied that you intend to leave the United Kingdom at the end of your exchange period."

15.3 Other employment "... but I am not satisfied that you do not intend to take employment other than under an approved scheme."
